Purchase

The purchase of the selected product can be initiated by clicking on the “to cart” button. Once the selected product is in the basket you can continue shopping. You can modify or change the ordered quantity of the product. The default quantity setting is 1 unit. The content of the basket is always displayed when you add products to it.

Information published on the webshop shall not be considered as offers. Eatbrain.net reserves the right to reject any orders made by the customer through the webshop – having regard to the actual stock of products – if the order cannot be completed. Eatbrain.net reserves the right to alter the price of any product – in particular for promotional sales. Eatbrain.net hereby states that the automatic reply message sent by the webshop shall not be considered as a signed written contract, or acceptance by Medeia Studio of the customer’s purchase offer.
If a product is out of stock, Eatbrain.net reserves the right to rescind the contract.

If you place an order with us, we request certain personal information. Our registered customers’ information is stored at eatbrain.net in order to complete the contracts and to confirm the terms of the contract at a later date. Your information will not be disclosed to a third party unless, while performing the contract, the party acts as a subcontractor of  eatbrain.net. In this case, however, subcontractors are not allowed to store, use or disclose to any other party in any way the personal information provided by eatbrain.net. Our data management procedure is in accordance with the Privacy Act. When registering and shopping, customers need to provide personal information (name, address, phone number, e-mail address, etc). This information is only requested in order to ensure the accurate completion of orders. Your information is used by our Customer Service to contact you if this is necessary for the completion of orders. For information about orders, customers are informed by e-mail or phone. We recommend that you provide complete registration information to enable our Customer Service to contact you as quickly as possible concerning your orders.

Warranty / Guarantee

All our products are warranted by us or our suppliers to the extent as defined in the provisions of the Civil Code. The warranty period is 6 (six) months. Customers have 2 (two) years to enforce warranty claims.

In the case of a warranty claim customers may demand:

a) Primarily repair or replacement (customer choice), unless the chosen remedy is impossible or would impose unreasonable additional costs on the webshop in comparison to the other remedy, taking into account the value of the item provided in an immaculate condition, the severity of non-compliance with the contract, and the inconvenience caused to the customer by the implementation of the remedy concerned;

b) If the customer is not entitled to either repair or replacement, or the webshop did not undertake to repair or replace the item or is unable to fulfil these obligations, customers can choose whether to demand an appropriate reduction in price or to rescind the contract. In the case of minor defaults customers may not rescind the contract.

No remedy can be claimed for defaults resulting from inappropriate use.

Remedies and quality claims can also be enforced in the case of reduced price products, provided that the trader did not specify the reason for the reduction. (Within 6 months of the date of purchase the trader has to prove that the product was immaculate at the time of purchase, or that the default occurred during use. After this 6-month period the customer has to prove that the product was already faulty at the time of purchase.)

 

Guarantee

The guarantee period shall start on the day when the consumer’s goods were handed over to the consumer, in accordance with Government Decree 151/2003.

 

Under guarantee claims the customer may decide:

a) Primarily repair or replacement(customer choice), unless the chosen remedy is impossible or would impose unreasonable additional costs on the webshop in comparison to the other remedy, taking into account the value of the item provided in an immaculate condition, the severity of non-compliance with the contract, and the inconvenience caused to the customer by the implementation of the remedy concerned.

b) If the customer is not entitled to either repair or replacement, or if the webshop did not undertake to repair or replace the item or is unable to fulfil its obligation, customers can choose whether to demand an appropriate reduction in price or to rescind the contract. In the case of minor defaults customers may not rescind the contract.

For defaults resulting from inappropriate use no guarantee claims can be enforced. Guarantee claims can also be enforced in the case of reduced price products, provided that the trader did not specify the reason for the price reduction (Government Decree 151/2003, Decree 49/2003 (VII.30) of the Ministry of Economy and Transport). (During the guarantee period and within the first 6 months of the warranty period the trader shall prove that the product was immaculate at the time of purchase, or that the default occurred during its use. After this 6-month period, however, it is the customer who has to prove that the product was already faulty at the time of purchase.)
